1. What Jhamly is
Jhamly (“the Service”) is an AI-powered tutoring platform for school students, operated through:
- the Student app — an AI tutor and practice system for school children;
- the Parent app — progress visibility and controls for parents/guardians; and
- Jhamly for Institutions — a management system (ERP) for schools, colleges, and tuition centres.
These Terms govern your use of the Service. By creating an account, you accept them. If you don’t agree, don’t use the Service.
The Service is an educational aid, not a school, examination body, or substitute for professional educational, medical, or psychological advice.
2. Who may use the Service, and how accounts work
2.1 Children cannot create accounts
Jhamly is built for children, but accounts are created and owned by parents or legal guardians, who must be 18 years or older. A child uses the Student app only through a Kid Profile created by their parent.
2.2 The parent account model
- A parent/guardian signs up with their own email (for example, Google sign-in) and accepts these Terms and thePrivacy Policy.
- The parent creates one or more Kid Profiles, each with a kid login code for the Student app.
- The parent is responsible for: the accuracy of information provided (including the child’s grade/board), supervision appropriate to the child’s age, all activity under Kid Profiles they create, and the security of the kid codes they share with their child.
- You represent that you are the parent or legal guardian of every child for whom you create a Kid Profile, or have the lawful authority to act for that child. Creating a profile for a child without such authority is prohibited and grounds for termination.
2.3 Institutional accounts
Schools, colleges, and institutes access Jhamly for Institutions under a separate written agreement with the institution. Institutional administrators are responsible for their authority to upload staff and student data and for managing their own users’ access. Terms between Jhamly and the institution are governed by that agreement; where it is silent, these Terms apply.
2.4 Account security
You are responsible for maintaining the confidentiality of your credentials and kid codes, and for all activity under your account. Notify us immediately at support@jhamly.com if you suspect unauthorised access.
3. The AI tutor — what it is and isn’t
- The tutor is AI, not a human teacher. It explains, asks questions, adapts, and encourages. It does not hold teaching credentials and does not replace school, teachers, or parental involvement.
- AI can be wrong. Jhamly invests in verification systems (solver-checked items, calibrated difficulty, verified answers) to make the tutor more reliable than a generic chatbot. Despite this, the tutor may occasionally produce an incorrect or incomplete explanation. Students are taught to verify important answers against their textbook and teacher — and we encourage parents to reinforce this.
- Assessments measure; they don’t certify. Quiz results, mastery levels, and practice-exam scores are instructional measurements to guide learning. They are not official grades and are not recognised by any board (CBSE, ICSE, state boards), school, or examination authority.
- No promises of outcomes. We design Jhamly to genuinely improve learning and we measure ourselves on that. We do not and cannot promise any specific exam result, rank, or admission.
- Not for emergencies. The tutor is not equipped to handle crises. Safety-related messages are routed to supportive resources and a parent may be notified as described in the Privacy Policy, but the Service is not a counselling or emergency service. In an emergency, contact local emergency services (112 in India) or the KIRAN helpline (1800-599-0019).
4. Acceptable use
You (and children under your profiles) may not:
- Use the Service for any unlawful purpose, or in violation of any applicable law.
- Upload, share, or attempt to elicit content that is sexual, exploitative, harassing, hateful, violent, or otherwise harmful to children. Any suspected child exploitation will be reported to appropriate authorities.
- Attempt to make the AI produce harmful content, bypass safety systems, or extract other users’ data (prompt injection, jailbreaking, scraping, probing).
- Use the Service to cheat in official examinations, impersonate another person, or misrepresent assessment results as official credentials.
- Copy, scrape, redistribute, resell, or commercially exploit the Service’s content, question banks, curricula, or software, except as expressly permitted.
- Interfere with the Service’s operation (excessive automated requests, attacks, malware) or attempt to access systems or data you aren’t authorised to access.
- Share kid codes or account access outside your household; create accounts through automated means; or create a Kid Profile for a child you are not responsible for (see §2.2).
Violation may result in suspension or termination (§10) and, where required, reporting to authorities.
5. Content and intellectual property
5.1 Our content
The Service — software, design, curricula organisation, question banks, the Jhamly name, logo, and buddy characters — is owned by Jhamly Private Limited and protected under the Copyright Act 1957, Trade Marks Act 1999, and other applicable law. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for personal, non-commercial educational purposes.
5.2 Your content
You and your child retain ownership of content you submit (questions asked, answers given, uploads). You grant us a limited licence to process that content solely to operate and provide the Service (tutoring, progress tracking, parent reports). We do not sell your content, do not use it for advertising, and do not use children’s conversations to train AI models — ours or anyone else’s. See thePrivacy Policy.
5.3 Feedback
Suggestions you send us may be used to improve the Service without obligation or compensation.
6. Subscriptions and payments
Paid plans are not on sale yet. The Service is currently offered as a free beta. When subscriptions launch:
- Current plans and prices will be shown in the parent app and on this website. Amounts will be billed in Indian Rupees and will include applicable GST (GSTIN 29AAHCJ3081C1ZN).
- Paid plans will be billed in advance (monthly or annually) in Indian Rupees. You will authorise recurring charges until you cancel.
- You may cancel at any time from the parent app (Settings → Subscription) or by emailing support@jhamly.com; access continues until the end of the paid period.
- Fees will be non-refundable except: (a) within 7 days of first purchase if the Service was materially defective; (b) where required by law, including the Consumer Protection Act, 2019.
- We will give at least 30 days’ notice before changing the price of an active subscription; the new price applies from your next renewal. If you don’t agree, cancel before renewal.
- Failed payments may result in suspension of paid features after notice.
7. Privacy and children’s data
Your use of the Service is also governed by thePrivacy Policy, which is part of these Terms. Key points, restated:
- Children use the Service only with verifiable parental consent, as required by the Digital Personal Data Protection Act, 2023.
- We do not serve behavioural advertising or track children for commercial purposes.
- Learning data from AI tutoring flows to the student and their parent — never to their school. Institution-managed data is strictly separated.
- Parents can access, correct, and delete their child’s data, and may withdraw consent at any time (withdrawal ends the child’s use of the Service).
8. Availability and changes to the Service
- We aim for high availability but do not warrant uninterrupted or error-free operation. Maintenance, updates, and factors beyond our control may cause downtime.
- We may add, change, or discontinue features. If we materially reduce a paid feature you subscribe to, we’ll notify you and, where the reduction is substantial, offer a pro-rata refund of the affected period.
- The Service is currently offered in India. Content is aligned to CBSE, ICSE, and Karnataka State Board curricula as described in the app; coverage depth varies by grade and subject and is shown in the app.
9. Disclaimers and limitation of liability
- As-is basis. To the maximum extent permitted by applicable law, the Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Nothing in this section limits any right you have under the Consumer Protection Act, 2019 that cannot lawfully be excluded.
- Educational disclaimer. See §3. Learning outcomes depend on many factors beyond the Service.
- Limitation of liability. To the maximum extent permitted by law, Jhamly Private Limited and its directors, employees, and agents shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill. Our total aggregate liability arising from or relating to the Service shall not exceed the amounts you paid us in the 12 months preceding the claim, or ₹5,000, whichever is greater. Nothing in this section excludes liability that cannot be excluded under Indian law, including liability for death or personal injury caused by negligence, or under the Consumer Protection Act, 2019.
10. Suspension and termination
- By you. You may stop using the Service and delete your account at any time via the parent app (Settings → Delete account) orsupport@jhamly.com. Deletion is handled per the Privacy Policy’s retention schedule.
- By us. We may suspend or terminate access if: you breach these Terms; we are required by law; continued provision poses a safety, security, or legal risk; or your payment fails and remains unresolved after notice. Where practicable, we’ll give notice and a chance to cure before termination.
- Effect. On termination: paid access ends per §6; you may request export of your child’s progress data within 30 days; deletion proceeds per the Privacy Policy.
11. Changes to these Terms
We may update these Terms. For material changes, we will notify registered users by email and/or prominent in-app notice at least 15 days before they take effect, and the “Last updated” date will change. Continued use after the effective date constitutes acceptance. If you don’t agree, stop using the Service and delete your account before the effective date.
12. Governing law and disputes
- These Terms are governed by the laws of India.
- Courts at Bengaluru, Karnataka shall have exclusive jurisdiction, subject to any mandatory consumer-rights provisions allowing you to proceed in your local forum under the Consumer Protection Act, 2019.
- Escalation first: before filing any claim, contact our Grievance Officer (Nishanth Divakar Raju, support@jhamly.com). We’ll attempt to resolve disputes within the statutory grievance timeline. Nothing here restricts your right to approach consumer forums or other authorities.
13. General
- Entire agreement: these Terms plus the Privacy Policy (and, for institutions, their separate agreement) are the entire agreement between you and us.
- Severability: if any provision is held unenforceable, the rest remain in effect.
- No waiver: our failure to enforce a provision is not a waiver.
- Assignment: you may not transfer your account; we may assign these Terms in connection with a reorganisation, merger, or sale, with notice.
- Force majeure: we are not liable for failures caused by events beyond reasonable control.
